Terms and Conditions of Online Sales

1.1 These general terms of sale govern the process and conditions of sale of products marketed through the online channel by OMCE di Rocchetti Amleto Spa (hereinafter OMCE or “supplier”). All purchases finalised through the above mentioned channel are governed by these general terms, which form an integral and essential part of every proposal, order and order confirmation of purchase of the products themselves.

2.1 All purchase orders must be made through the electronic procedure available on the website www.omcestore.it and will need to be completed in each required field allowing the supplier the correct identification of the products ordered. The order is considered to be completed successfully with the making of the payment by the PayPal service.

2.2 Fulfilling of the order by OMCE is the equivalent of confirmation and acceptance of the same. OMCE SPA reserves the right not to accept incomplete orders.

3.1 The type of products purchased through the online store is only that available in the area assigned to the aforementioned sales channel. The products are not supplied on trial: without prejudice to the right of withdrawal referred to in paragraph 6) below, the Customer is responsible for the choice of the products ordered.

3.2 For each order a total quantity not exceeding 12 pieces can be indicated.

3.3 The prices of the products are published with and without VAT and the price is inclusive of the CONAI contribution.

4.1 Deliveries are carried out in Italy ex factory.

4.2 The tax documentation relating to the products ordered will be issued by OMCE on delivery of the products to the customer. If the customer has a VAT number and wishes to receive the invoice in its own name, this request must be state

5.1 The products are guaranteed only for defects or non-compliant manufacture according to the terms of the law and the specifications in force for the sector (for steel reference is made to http://www.sefa.be/home.html and for plastic, without international regulations, to our user manuals downloadable from the login area of our website). Any defects or non-compliant manufacture must be reported by the customer, under penalty of forfeiture, within and no later than 8 (eight) days for professional customers and within and no later than two months for consumer customers. The customer will be entitled to a replacement or repair of the damaged products against return of the same, with the exclusion of compensation of any damage. The shipping costs are charged to the customer.

6.1 If the customer can be qualified as “consumer” pursuant to consumer laws, the latter has the right to withdraw from the contract and to return the products ordered, without any penalty and without specifying the reason within 14 (fourteen) days from receipt of the products themselves. The right of withdrawal must be exercised by the customer, under penalty of forfeiture, by sending a registered letter to the supplier within the abovementioned term.

6.2 All returns must be perfectly intact and accompanied by the original packaging. Once the products have been received as carriage paid and their intact condition ascertained, OMCE will credit the customer the cost of the returned products (as indicated on the invoice or receipt).

7.1 Where there is no departure, or potential departure, from the present general terms of sale the relations between customer and supplier will be governed by relevant Italian law.

7.2 Without prejudice to the applicability of mandatory rules of law for consumer protection, any dispute in any way related to these General Terms will be submitted to the exclusive jurisdiction of the Court of Ancona.

7.3 Pursuant to and for the purpose of Articles 1341 and 1342 of the Civil Code, the Customer declares having carefully read and understood and accepted specifically the present General Terms of sale.

8.1 The customer shall give OMCE spa consent for the processing of personal data (as indicated on the page “Privacy & Cookie Policy”) provided within the scope of the present contract for every and any purpose functional to the execution of the same contract, including the communication to third parties to which OMCE delegates one or more obligations depending directly or indirectly on this contract. The Customer authorizes OMCE Spa to handle and store personal data. These data will be stored and handled at and under the responsibility of OMCE spa and will be used exclusively in the context of activities related to the implementation of this Agreement and in fulfilment of the obligations of law. At any time the purchaser will be able to gain knowledge of, update or rectify the data relating thereto and will be able to arrange also for these data be deleted or transformed into anonymous form. The customer may at any time request the blocking of data possibly handled in violation of the law or of the purposes for which they were collected.
